Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Haysinda websites, Marvella ERP portals, AI agents, and related integrations (including Meta WhatsApp and Lead Ads where enabled).

1. Agreement

By accessing our websites or using Marvella, you agree to these Terms and our Privacy Policy. If you use Marvella on behalf of a company, you confirm you are authorized to bind that company.

2. Services

Haysinda provides Marvella, a multi-tenant business ERP with optional AI agents and messaging integrations. Features available to you depend on your subscription, tenant configuration, and enabled modules.

3. Accounts and responsibilities

You are responsible for:

  • Keeping login credentials secure and limiting access to authorized users.
  • The accuracy of data entered into your Marvella tenant.
  • Compliance with applicable laws when messaging customers (including WhatsApp and advertising rules).
  • Obtaining any required consents before contacting individuals through messaging or ads.

4. Acceptable use

You may not misuse the services, including by attempting unauthorized access, disrupting service availability, uploading unlawful content, or using messaging features to spam or harass others.

5. Third-party platforms

Integrations with Meta (Facebook, Instagram, WhatsApp), payment providers, telephony, or AI vendors are subject to those providers’ terms. We are not responsible for outages or policy changes on third-party platforms.

6. Intellectual property

Haysinda and its licensors own Marvella software, branding, and related materials. You retain ownership of your business data. You grant us a limited license to host and process that data solely to provide the service.

7. Limitation of liability

To the maximum extent permitted by law, Haysinda is not liable for indirect, incidental, or consequential damages, or for losses arising from third-party platform decisions, network issues, or data you choose to enter into the system. Our aggregate liability related to the services is limited to fees you paid us for the service in the three months before the claim, where applicable.
